About these terms

These Terms & Conditions apply when you use this website, create an account, buy products, book catering or masterclasses, access digital content, apply as a stockist, subscribe to updates, or contact Under the Hood BBQ.

By using the website or placing an order, you agree to these terms. If you are buying on behalf of a business or organisation, you confirm you have authority to accept these terms for that organisation.

Products, availability, and pricing

  • Products, flavours, stock levels, class places, catering dates, and digital content availability may change without notice.
  • Prices are shown in New Zealand dollars unless stated otherwise. GST, shipping, discounts, and payment processing fees are calculated at checkout where applicable.
  • We may correct pricing, product, stock, or checkout errors. If an error affects an order you have placed, we will contact you and either confirm the corrected order or cancel and refund the affected amount.
  • Product images and descriptions are provided to help you choose, but packaging, batches, ingredients, availability, and presentation may vary.

Orders and payment

An order is not accepted until we confirm it or start fulfilment. We may refuse, cancel, or limit an order where products are unavailable, payment fails, fraud checks raise concerns, details are incorrect, or the order cannot reasonably be fulfilled.

Online card payments are processed through Stripe. You must provide accurate billing, shipping, contact, and payment information. You are responsible for any bank, card, currency conversion, or international fees charged by your provider.

Shipping and delivery

  • Delivery times are estimates only and may be affected by courier, address, stock, weather, event, or operational delays.
  • Risk in physical goods usually passes on delivery to the address you provided, but your rights under the Consumer Guarantees Act 1993 still apply.
  • You are responsible for providing accurate delivery details. If an order is returned, delayed, lost, or misdelivered because details were incorrect, we may need to charge additional delivery or replacement costs.
  • If an order arrives damaged, incorrect, or missing items, contact us as soon as possible with your order number and photos where relevant.

Refunds, returns, and cancellations

Your rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986 are not limited by these terms. If a product or service fails to meet a consumer guarantee, we will provide the remedy required by law, which may include repair, replacement, refund, or another appropriate solution.

  • Faulty, damaged, unsafe, misdescribed, or incorrect products: contact us promptly. Please keep the product, packaging, and proof of purchase while we assess the issue.
  • Change of mind: we do not have to provide a refund or exchange for change-of-mind purchases, but we may choose to help where the item is unopened, unused, in resaleable condition, and returned within a reasonable time. Shipping and processing fees may not be refundable unless required by law.
  • Food and perishable items: returns may be declined where safety, hygiene, opened packaging, storage, or handling means the item cannot be resold, unless the product is faulty or the law requires a remedy.
  • Gift cards and digital products: refunds may be unavailable once issued, redeemed, downloaded, or accessed, unless required by law.
  • Catering and events: deposits, booking fees, menu costs, date holds, supplier costs, and cancellation windows may be handled under the booking terms supplied for that event or booking.
  • Refund timing: approved refunds are usually returned to the original payment method. Bank and payment-provider processing times can vary.

Catering, masterclasses, and digital content

  • Catering enquiries are requests until accepted by us. Dates are not confirmed until we approve the booking and any required deposit or confirmation step is complete.
  • Masterclass bookings are subject to available places, location rules, event requirements, and any class-specific cancellation or transfer terms.
  • Digital course access is for the purchaser or authorised account holder only. Do not share login details, stream links, course videos, downloadable materials, or private content without our written permission.
  • We may change class dates, locations, menus, instructors, or content where reasonably necessary. If we cancel an event or cannot provide a paid service, we will contact affected customers about available options.

Accounts and security

  • You must provide accurate account information and keep it up to date.
  • You are responsible for keeping login details secure and for activity under your account unless caused by our breach or legal responsibility.
  • We may suspend or restrict account access if we reasonably believe there is fraud, misuse, security risk, unlawful activity, or breach of these terms.

Acceptable website use

  • Do not misuse the website, interfere with security, scrape content at scale, attempt unauthorised access, submit false information, upload malicious material, or use the site for unlawful activity.
  • Do not copy, reproduce, adapt, sell, or exploit our branding, recipes, images, videos, course content, product copy, or website materials without permission, except as allowed by law.

Marketing and communications

We may send service messages about your account, orders, bookings, course access, or enquiries. We only send marketing emails where we have consent or another lawful basis, and you can unsubscribe from marketing messages.

Liability

Nothing in these terms excludes, restricts, or modifies rights that cannot be excluded under New Zealand law. To the extent allowed by law, we are not liable for indirect loss, loss of profit, loss of data, business interruption, or losses caused by events outside our reasonable control.

Where our liability can be limited, it is limited to the amount you paid for the affected product or service, or the remedy required by law.

Governing law

These terms are governed by New Zealand law. The New Zealand courts have non-exclusive jurisdiction over disputes relating to these terms, the website, products, or services.
